The buyer is liable to have knowledge of terms of puchase prior to making a bid. When a bid is put down the bidder accepts the terms of purchase. All of our objects are described to the best of Karljohan Auktioner's possibility, both in text and image, and is sold in current condition.

The bidder has the final responsibility in checking the condition and authenticity of the object prior to bidding. Karljohan Auktioner is not responsible for any possible wear, damages and/or defects.

Technical and electronic objects are tested and described as best possible, but are sold without any warranty of function.

Karljohan Auktioner's responsibilty only reaches as far as the price, including buyers premium, that the buyer has paid. Karljohan Auktioner is not responsible for any additional costs that may have affected the buyer after purchase.
For obects not collected within the stated time period the responsibility of Karljohan Auktioner lapses.

General

To bid at our auctions you need to have a registered account. This is obtained through a registration process available on this website. The responsibility for this account is solely on you as a customer, as is keeping this account secure from other persons. In order for Karljohan Auktioner to maintain your account you accept our right to save the needed personal information for billing and/or making payment after sales.

No personal information will be shared with third-party. This consent in storage of personal information applies until the customer cancels it. This cancellation needs to be made in writing Karljohan Auktioner AB. Even after such a cancellation Karljohan Auktioner AB has the right to store any and all information needed to correspond with Swedish accounting law. Our privacy policy can be found here.

The bidder with the highest bid after the auction finishes is considered the buyer of said object. Each account holder are responsible for his/her bids, even if they're made on account of someone else.

In the event of two finishing bid of the same amount, the bidder that laid down his/her bid first is considered the buyer.

Karljohan Auktioner is not responsible for bids laid, but not registered. This regardless of failure to register due to technical error, negligence or any other reason.

All bids need to be made through our web interface, or in contact with us in good time before the auction ending. Any and all bids that come in within the last two minutes of an auction ending will result in additional time of two minutes being added for this object. For bids of the same amount it's always the bidder that entered his/hers first that has the leading bid.

All bids are considered binding and can not be withdrawn.

For all objects the lowest bid possible is SEK 100.

Payment

I addition to the winning bid there is also a buyers premium of 22,5% along with a hammer fee of SEK 40 added. VAT included.

After auction conclusion all of your purchases will be added to a payment order. This payment order will be sent to your E-mail approximately an hour after the auction ending. Until this has been received no payment can be made.

Payment must be made no later than seven (7) days after auction.
In failure to do so you will receive a reminder via E-mail. If no payment still is made Auktioner has the right to cancel the purchase and relist the item at a coming auction.

Payment can be made through bank transfer, debit or credit card (via 'My Pages' or upon pickup) or via Swedish digital transfer service 'Swish'.
Payments made via bank transfer or 'Swish' should be labeled with the payment order numer.

Collection

Upon collection of won item(s) payment needs to be registered. For items not picked up within seven (7) days after auction an added storage fee of SEK 100 per week is added. Consequently Karljohan Auktioner's responsibilty for the item lapses.
For items bought and paid, but not collected within the time period stated in the traders right to sell uncollected items (1985:982), Karljohan Auktioner has the right to sell the items at auction

Shipping

If the buyer hasn't the possibility to come collect won item(s) Karljohan Auktioner can arrange with shipping through partnering couriers. For exceptionally bulky items it is recommended to contact us for a shipping quote prior to bidding.
No objects are handed over to courier until paid in full.

Description of objects

All objects are sold 'as presented'. They're presented, both in text and image, to the best of Karljohan Auktioner's possibility. Said description is subject to change up until the time of auction conclusion. In case of changes that Karljohan Auktioner deem a sufficiently large departure from the prior description the highest bidder will also be notified via E-mail.
Due to age and/or specific material characteristics the objects can sometimes be collected with flaws not possible to list at the time of the cataloging.

Photos are mainly considered for identification and can not, fully, be used to evaluate an objects condition. Deviations can occur. We recommend all prospective buyers to personally view items at our showroom or to write specific inquiries in good time before auction conclusion.

Measurements, both in size and weight, are considered approximate. Complaints in respect to this are considered only in cases where the difference makes a substantial difference in value.

If questions on a specific items authenticity should arise, this needs to be immediately taken up with Karljohan Auktioner. Should it be concluded that the item is, in fact, not authentic or afflicted with such flaws that the winning bid of said auction

Uppstår tvivel om ett visst objekts äkthet så ska detta omgående tas upp med Karljohan Auktioner. Skulle det visa sig att objektet verkligen är en förfalskning eller att det är behäftat med så väsentliga fel att det medfört att slutpriset i den aktuella auktionen blivit väsentligt annorlunda mot om en korrekt beskrivning funnits så har köparen rätt att göra en reklamation som innebär att hela köpesumman återbetalas.

I det fall det köpta föremålet skulle vara en förfalskning, eller om beskrivningen varit behäftad med väsentliga fel, som medfört ett väsentligt högre slutpris än vad en korrekt beskrivning antas ha resulterat i, har köparen rätt att göra en reklamation. Därefter återbetalas den totala köpesumman.

Reklamation ska meddelas auktionshuset utan dröjsmål. Det är endast den ursprungliga köparen av objektet som kan åberopa ångerrätt. Föremålet måste returneras i samma skick som det var vid försäljning. Köparen kan ej avkräva Karljohan Auktioner på kostnader andra än köpesumman för objektet.

Objektens kondition

Karljohan Auktioner tar på sig att, i de fall det är möjligt, informera närmare om specifika objekts kondition och skick. Detta främst för kunder som ej själva har möjlighet att besöka vår visningslokal och själva kontrollera objekten. Det är endast skriftliga konditionsrapporter som kan användas för reklamation.

Ångerrätt

Enligt lagen om distansavtal och avtal utanför affärslokaler (2005:59) har du som konsument en ångerrätt som sträcker sig 14 dagar efter det att du som köpare fått objektet i besittning. Denna tid räknas även från det att eventuellt ombud utsett av köparen fått objektet i besittning. För näringsidkare gäller ej denna ångerrätt, ej heller om undantag från ångerrätten i nämnda lag kan tillämpas.

Ska ångerrätten åberopas så ansvarar köparen för att meddela Karljohan Auktioner innan ångerfristen om 14 dagar hunnit löpa ut. Man åberopar ångerrätt genom att kontakta oss via mejl info@karljohanauktioner.se och då ange sitt kundnummer, objektsnummer samt delge kontouppgifter för återbetalning. Därefter ansvarar köparen också för att, på egen bekostnad, se till så att objektet kommer Karljohan Auktioner åter. Objektet ska vara paketerat på så vis att det returneras auktionshuset i samma skick som vid det såldes i. Har objektet skadats vid transport eller p.g.a. köparens handhavande har Karljohan Auktioner ingen skyldighet att godkänna ånggerätten.

Objektets kostnad plus köparavgifter återbetalas köparen 14 dagar efter det att föremålet återlämnats Karljohan Auktioner.

Undantag för ovan nämnda lag gäller vid föremål av guld, silver eller platina. Detta då det avser en vara som är beskriven enligt ”avser en vara eller tjänst vars pris beror på sådana svängningar på marknaden som näringsidkaren inte kan påverka och som kan inträffa under ångerfristen” i kapitel 11, paragraf 2.

Karljohan Auktioner har rätt att stänga ned en kunds konto i de fall de misstänker att kunden missbrukar ångerrätten för att slippa stå för sina bud vid återkommande tillfällen.

Det är ej tillåtet att bjuda på objekt som man tidigare vunnit och sedan åberopat ångerrätt.

Följerätt/Droit de suite

Enligt paragraf (1960:729) om upphovsrätt till litterära och konstnärliga verk tillkommer en avgift vid försäljning av konstnärligt utformade bruksföremål och konstverk (tavlor, skulpturer, grafik, keramik, silver och dylikt) fram t.o.m 70 år efter konstnärens död. Avgiften är 5% på klubbat pris och går till konstnären eller dennes efterlevande. För aktuella föremål noteras detta på auktionssidan.

Överstiger klubbat belopp ej 5% av basbelopp (47600 kr, 2021) så utgår ingen avgift.

Exporttillstånd

Enligt lagen om kulturminnen m.m. (1998:950) krävs vi vissa fall tillstånd för att utförsel av vissa svenska och utländska kulturföremål ska kunna ske. Om detta kan man läsa på Riksatikvarieämbetets hemsida, www.raa.se.

Tvistemål

Eventuella tvister mellan Karljohan Auktioner och köpare rörande villkoren som är stipulerade ovan avgörs i enlighet med svensk lag i svensk domstol.
