1. Karljohan Auktioner AB commitment

Karljohan Auktioner AB undertakes to sell items submitted by the seller as an auctioneer on the terms specified below. Karljohan Auktioner AB has the right to sell the submitted item at the auction occasion which, according to Karljohan Auktioner AB's assessment, gives the best result or for some other reason is most suitable.

2. Submission

2.1 The seller is responsible for having full and unrestricted ownership of items that he leaves to Karljohan Auktioner AB for sale or, if the item is owned by a third party, that he has a full and unrestricted right to sell and receive payment for this item.

2.2 If the seller does not own the item, which he leaves for sale, he must prove in writing his authority to sell the item. However, Karljohan Auktioner AB is not obliged to check the seller's authorization to sell the item without special reason.

2.3 As soon as Karljohan Auktioner AB decides to undertake the assignment to sell the item, a written / digital sales agreement shall be established between Karljohan Auktioner AB and the seller.

2.4 Karljohan Auktioner AB reserves the right to unilaterally and without the right to compensation to the seller withdraw from a sales assignment of a certain object if doubt arises regarding the object's authenticity, ownership of the object or other information that Karljohan Auktioner AB deems essential.

2.5 The seller or the person submitting the item is obliged to inform Karljohan Auktioner AB of known defects and deficiencies in the item.

2.6 Withdrawal of the sales order must be made in writing. In no case does the seller have the right to revoke the sales assignment without the consent of Karljohan Auktioner AB later than three days before the item begins to be shown to the public. If the seller revokes the sales assignment, he shall reimburse Karljohan Auktioner AB for costs for handling and valuation of the items, etc. with an amount corresponding to sales taxes according to section 4.1 calculated on the asking price.

2.7 All transports of items to and from Karljohan Auktioner AB take place at the seller's expense and at the seller's risk.

 

3. Cataloguing

3.1 Karljohan Auktioner AB has the full and unrestricted right to decide how objects are to be described and how objects are to be depicted on the Internet.

3.2 All photographs and images are the property of Karljohan Auktioner AB and may, without special compensation, also be used for purposes that are not related to the sale.

3.3 The valuation price is based on a market-adapted valuation of the item prior to the auction. The asking price is only an estimation and a guide for buyers and the price at which an item is finally sold can significantly exceed or fall below the asking price.

4. Sales fees

4.1 For each auction item, a commission of 20% incl. VAT on the clubbed amount and a fixed fee of SEK 30 incl. VAT for photo, handling and insurance.

 

5. Storage and insurance

5.1 Submitted items are insured by the reception by Karljohan Auktioner AB against damage in connection with burglary, fire or water damage, and against theft or breakage to a value maximum corresponding to the asking price minus sales fees or clubbed price minus sales fees, unless a special agreement on other insurance value has been concluded.

5.2 Karljohan Auktioner AB is responsible for ensuring that submitted items are stored in a secure manner.

5.3 Karljohan Auktioner AB can not be held responsible for damage to picture glass and frames or for natural changes in living materials such as bleaching of paper and cracks in wood or wear in connection with display.

5.4 Karljohan Auktioner AB is not obliged to compensate the seller for any damage in excess of the insurance value of the submitted item in accordance with clause 5.1.

5.5 Karljohan Auktioner AB liability for submitted items is limited to what is stated in these terms.

 

6. Reserve price

6.1 Reserve price means that Karljohan Auktioner AB, on behalf of the Seller, monitors that items are not sold below the agreed acceptance price. The acceptance price may not exceed the asking price. The acceptance price must be confirmed in a contract. Reserve prices are not used for items with a valuation of less than SEK 1,000. For reserve prices it is commonplace to use 70-80% of the estimate price. The agreed acceptance price shall be approved by Karljohan Auktioner AB and shall be confirmed in the sales agreement or in writing at a later time by agreement with Karljohan Auktioner AB.

6.2 If an item does not reach the reserve price or finishes without bids received, the item is returned to the seller.

6.3 Karljohan Auktioner AB has the right to sell an item below the reserve price, provided that the seller is paid as much as if the sale had reached the acceptance price.

 

7. Accounting

7.1 After the auction, the seller receives a written preliminary report of the auction result.

 

8. Payment

8.1 Payment to the seller takes place no later than twenty nine (29) days after the end of the auction, provided that full payment has been received from the buyer and that no complaint, cancellation or exercise of statutory right of withdrawal has taken place. When selling to a consumer, the buyer has a statutory withdrawal period of fourteen (14) days from the buyer taking possession of the item (withdrawal period). If the buyer's withdrawal period has not expired at the time of regular payment, the payment to the Seller is postponed to five (5) banking days after the withdrawal period expires, provided that the buyer has not notified Karljohan Auktioner AB within the withdrawal period that the buyer wishes to exercise his right of withdrawal. If the buyer has notified Karljohan Auktioner AB of this but does not return the item within the statutory time (return period), Karljohan Auktioner AB has the right to demand fulfillment of the purchase towards the buyer. In such a case, the payment to the Seller is postponed to five (5) banking days after the return deadline (ie to a maximum of twenty-eight (28) days, plus five (5) banking days, from the time the buyer is considered to have taken possession of the item).

8.2 Karljohan Auktioner AB keeps payments received from buyers separate in the client funds account in accordance with the Accounting Funds Act.

8.3 If the buyer has exercised a statutory right of withdrawal within the withdrawal period, the sale is canceled and the item is put up for new sale with unchanged terms of sale.

8.4 If the buyer has not paid in full at the time of payment in accordance with clause 8.1, or if a complaint has been made, the sale will be canceled, unless Karljohan Auktioner AB and the seller agree to continue to demand payment from the buyer. Karljohan Auktioner AB has no obligation to take action against the buyer unless a special agreement has been reached with the seller.

8.5 If the seller has a due debt with Karljohan Auktioner AB, Karljohan Auktioner AB has the right to set off such a debt before payment is made to the seller.

 

9. Unsold items

9.1 If an item is not sold and unless otherwise agreed, Karljohan Auktioner AB has the right to resell the item at auction for a second try again without prior notice. If the item doesn’t sell at the first or second auction date the item is considered unsold. Items unsold needs to picked up no later than 7 days after the auction.

9.2 If the item has not been picked up in accordance with section 9.1, Karljohan Auktioner AB has the right to donate the item to charity or resell the item with a reduced reserve, even without the seller's written approval.

9.3 If the seller has overdue debt with Karljohan Auktioner AB, Karljohan Auktioner AB has the right to contain unsold items as security for the seller's payment for such debt.

9.4 In the event of the seller's failure to pay due debt with Karljohan Auktioner AB, or to pick up unsold items according to clause 9.1, Karljohan Auktioner AB has the right to take the following measures:
(I) Delivery of items to warehouse at any forwarding company. All transport and storage costs are charged to the seller.
(II) Resale of the item on behalf of the seller. Karljohan Auktioner AB has a full and unrestricted right to determine the form of the auction, the asking price and whether the item is to be assigned a security price or not. Karljohan Auktioner AB has the right to deduct compensation from the amounts received for all receivables that Karljohan Auktioner AB has towards the seller.

 

10. Responsibility

If Karljohan Auktioner AB becomes liable to the buyer for defects in sold items, Karljohan Auktioner AB has the right to demand compensation from the seller corresponding to the compensation that Karljohan Auktioner AB may have issued to the buyer due to the defect. The seller understands the general terms and conditions that Karljohan Auktioner AB applies to buyers at auctions.

11. Personal information, money laundry, etc.

11.1 Personal information, such as name, address, social security number, telephone number and e-mail address, provided in connection with Karljohan Auktioner AB's services or otherwise within the framework of a contractual relationship with Karljohan Auktioner AB, is used for administration and fulfillment of Karljohan Auktioner AB's obligations attributable to the auction business, to be able to provide good service and to fulfill obligations under law. Personal data may also be processed for market and customer analyzes and statistics as well as for marketing purposes, such as targeted advertising, administrative announcements, product offers, newsletters, etc.

11.2 Personal data may be updated and supplemented by collection from private and public registers.

11.3 Personal information may, for specified purposes, be disclosed to companies with which Karljohan Auktioner AB cooperates.

11.4 Karljohan Auktioner AB applies the law (2017: 630) on measures against money laundering and terrorist financing in all its operations. This legislation is based on mandatory EU directives. As a result, additional personal data may be processed by Karljohan Auktioner AB.

11.5 The seller has the right, upon written request, to receive written information about what personal information Karljohan Auktioner has registered and how this information is used. The Seller also has the right to request that Karljohan Auktioner AB correct or delete incorrect information about the Seller. Anyone who does not want his / her personal data to be processed for purposes relating to direct marketing must send a written request to this effect to Karljohan Auktioner AB. 12. Force majeure

Karljohan Auktioner AB is exempt from the penalty for failure to fulfill a certain obligation under this agreement if the failure is based on a circumstance of the type stated below and the circumstance prevents or significantly impedes the timely fulfillment thereof. Relieving circumstances shall include acts of war, currency restrictions, shortage of means of transport, fire, government action, amended legislation, labor disputes, general shortage of goods, restrictions on driving force, accidents or similar circumstances. If Karljohan Auktioner AB's fulfillment of a certain obligation is delayed by more than three months due to a liberating circumstance, the seller is entitled to terminate the agreement in writing without obligation to pay compensation.

13. Dispute

Disputes regarding these conditions shall be settled in accordance with Swedish law in a court in Sweden.
